Terms of Service

These Terms govern your use of Plixa ("the Service"). By creating an account you agree to these Terms.

1. The Service

Plixa provides automated WhatsApp customer service on top of the Evolution API. You are responsible for the WhatsApp number(s) you connect, for the conversations you and our AI hold with your customers, and for compliance with WhatsApp's own policies.

2. Account

You must provide accurate registration information. You are responsible for keeping your password secure and for all activity under your account. Notify us immediately at [email protected] if you suspect a compromise.

3. Acceptable use

You must not use Plixa to:

  • Send mass unsolicited messages (cold outreach) to contacts who have not opted in.
  • Send messages that violate WhatsApp's Commerce or Business policies.
  • Phish, defraud or harass recipients.
  • Distribute malware or illegal content.
  • Resell the API or sublicense access without our written consent.

Plixa enforces these rules with automated detection (volume anomalies, reported numbers, banned domains). Violations may lead to immediate suspension and account termination without refund.

4. WhatsApp account bans

WhatsApp may, at its sole discretion, ban any number that breaks its own policies. Plixa cannot prevent or reverse a WhatsApp ban. We provide guidance, rate limits and warm-up policies to reduce risk, but you accept the residual risk by using the Service.

5. Pricing & billing

Plans and prices are listed on our pricing page. Subscriptions renew monthly until cancelled. Annual plans renew yearly. All charges are processed by Stripe in USD unless stated otherwise.

We may change prices with at least 30 days notice for existing subscribers; the change applies on your next billing cycle.

6. Cancellation

Cancel anytime from the dashboard. Cancellation stops the next renewal; the current paid period stays active until its end date. After cancellation, your data remains available for export for 30 days, then is permanently deleted.

Refunds are issued at our discretion within 7 days of the original charge, in line with consumer protection laws applicable to you.

7. Trial

New accounts get a 7-day free trial on the Professional plan without entering a credit card. After 7 days, the account is paused until you add a payment method.

8. Intellectual property

Plixa retains all rights to the Service, our brand and the underlying code. You retain all rights to the content you and your customers exchange through Plixa.

9. Warranty disclaimer

The Service is provided "as is" without warranty of any kind, express or implied. We do not guarantee uninterrupted access, error-free operation, or that WhatsApp will accept every message we send on your behalf.

10. Limitation of liability

To the maximum extent permitted by law, Plixa's total liability for any claim is capped at the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental or consequential damages.

11. Termination

We may suspend or terminate accounts that violate these Terms or that pose a risk to other customers or the underlying infrastructure. You may close your account at any time.

12. Governing law

These Terms are governed by the laws of Brazil. Disputes are resolved in the courts of São Paulo, SP, unless mandatory consumer protection law in your jurisdiction requires otherwise.

13. Changes

We may update these Terms. Material changes will be announced by email at least 30 days in advance.
